5. Credits and Payment

• Our Service operates on a credit-based system. Credits are required to generate content.
• Free accounts receive a limited number of credits upon registration.
• Additional credits can be purchased through subscription plans or one-time credit packs.
• All purchases are final and non-refundable, except as required by applicable law.
• Subscription plans renew automatically unless cancelled before the renewal date.
• Prices are subject to change with reasonable notice to existing subscribers.

6. User Content and Intellectual Property

6.1 Your Content

• You retain ownership of the text prompts and images you upload to our Service.
• By uploading content, you grant us a limited license to process and store it as necessary to provide the Service.
• You represent that you have the right to upload any content you submit and that it does not infringe third-party rights.

6.2 Generated Content

• Subject to your compliance with these Terms and your subscription plan, you own the AI-generated videos and images created through our Service.
• Commercial use of generated content requires an active commercial license (included with yearly plans and Ultra monthly plans).
• We may use anonymized, aggregated data about generated content to improve our Service.

6.3 Restrictions

You agree not to use our Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Create deepfakes or misleading content that impersonates real individuals without consent.
• Generate content that infringes on intellectual property rights of others.
• Produce content depicting child exploitation or abuse in any form.
• Create content for the purpose of harassment, bullying, or discrimination.
• Circumvent any content moderation or safety systems.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or servers connected to the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Happy Horse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Happy Horse and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

• You may terminate your account at any time by contacting us at support@aihappyhorse.ai.
• We may suspend or terminate your access to the Service at any time for violation of these Terms.
• Upon termination, your right to use the Service ceases immediately.
• Provisions that by their nature should survive termination shall remain in effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Happy Horse operates, without regard to conflict of law provisions.
